As you have likely heard, on Thursday, September 9, 2021, President Biden announced that the Department of Labor’s Occupational Safety and Health Administration (“OSHA”) is developing a rule that will require all employers with 100 or more employees to ensure that their workforce is fully-vaccinated or require any workers who remain unvaccinated to produce a negative test result on at least a weekly basis before coming to work. OSHA will issue an Emergency Temporary Standard (“ETS”) in order to implement this requirement.
At this time, employers with 100 or more employees must wait for OSHA to issue the ETS. Thereafter, CAL-OSHA will have thirty (30) days to adopt a standard that is at least as effective as the federal mandate.
